The IR35 reforms were briefly reversed in 2022 – unfortunately, that lasted just three weeks. Instead, the Prime Minister and Chancellor who made the announcement ended up on the scrapheap – and the legislation remains stubbornly in place.

2023 marks the two-year anniversary of reforms to IR35 in the private sector. We can expect to see clients and agencies continuing to grapple with compliance, and HMRC ramping up enforcement. There will be more ‘old’ Chapter 8 cases in the courts, and we should hear something from government on ‘set-offs’ which should ensure work isn’t taxed twice (at the moment there is a genuine risk that it could be).

This year will also be crucial for HMRC’s Managed Service Company enforcement. We expect to see tribunals which will be of great interest to those contractors unfortunate enough to be caught up in the current inquiries, and to anyone who uses specialist accountancy services providers.

Furthermore, we recently saw another delay to the MTD roll out, which has led many to question whether the design of MTD is still fit for purpose.
