Burrowing into Copyright

  • Mark Kreling

We know that rabbits tend to procreate pretty rapidly. But when discount supermarket chain Lidl tried to breed their own chocolate bunny, famous Swiss chocolatier Lindt got hopping mad. They took the retailer to court over the reproduction and last week the Federal Supreme Swiss Court agreed with them, ruling that Lidl's chocolate bunnies wrapped in aluminium foil, whether 'golden or of another colour', were too similar to Lindt's. It banned the chain's Swiss branches Lidl Schweiz and Lidl Schweiz DL from selling similar bunnies and ordered the destruction of any still in stock. The treats will be melted down. The ruling follows others, like the sweet revenge Marks and Spencers got against Aldi for their version of Colin the Caterpillar, which was withdrawn after a confidential settlement between the two companies. Large companies have a lot invested in their most recognizable brands, and it is not uncommon for them to defend them vigorously.
